The terms that apply when you use our website, make a booking or hire plant and equipment from LJM Plant Hire.

1. About these terms
These Terms & Conditions apply to your use of the LJM Plant Hire website and, where applicable, to quotations, bookings and the hire of plant or equipment from LJM Plant Hire.
Please read them before making a booking. By submitting a booking and entering into a hire with us, you agree to the terms that apply to that booking.
Nothing in these terms affects any rights you may have under law which cannot lawfully be excluded or restricted.
2. About LJM Plant Hire
LJM Plant Hire provides plant and equipment hire services in the United Kingdom.

3. Using our website
You may use our website for lawful purposes, including browsing available plant, requesting information and making or managing bookings.
You must not misuse the website, attempt to gain unauthorised access to our systems, interfere with the operation of the website or use it for fraudulent or unlawful purposes.
We may change, suspend or withdraw website functionality where reasonably necessary for maintenance, security or operational reasons.
4. Plant information and availability
We take reasonable care to describe plant and equipment accurately. Images may be illustrative and minor differences in appearance, specification or configuration may occur.
Plant availability can change and remains subject to operational requirements, previous hires, maintenance, breakdowns and other circumstances outside our reasonable control.
Where particular specifications are essential to your work, you should make this clear before the hire begins.
5. Making a booking
Our online booking system allows you to select plant, choose hire dates and provide the information required for the proposed hire.
You are responsible for ensuring that the information supplied during the booking process is complete and accurate.
Submitting information through the website does not require LJM Plant Hire to provide equipment where we cannot reasonably fulfil the hire.
We may contact you where information needs to be clarified before the hire proceeds.
6. Identity verification
We may require identity and address verification before releasing plant or equipment.
This may include providing a valid driving licence, proof of address or other appropriate identification.
We may refuse or delay a hire where required identification has not been provided, cannot reasonably be verified, appears to be inaccurate or where we reasonably consider further verification necessary to protect against fraud, theft or misuse.
7. Prices
The applicable hire price will be shown during the booking process, stated in a quotation or otherwise agreed with you before the hire.
Additional amounts may apply where relevant to the booking, including delivery, collection, extensions or other services requested by the customer.
LJM Plant Hire is not currently VAT registered. Prices displayed by us therefore do not include VAT unless expressly stated otherwise.
If an obvious pricing or technical error occurs, we will not be required to fulfil a booking at a price that could not reasonably have been intended. We will contact you to resolve the issue and, where appropriate, refund amounts already paid.
8. Payment
Where payment is required online, payment is processed securely through Stripe.
Your booking may remain pending until the required payment has been successfully authorised or received.
You must be authorised to use the payment method supplied and ensure that sufficient funds are available.
If a payment fails, is reversed, disputed or otherwise becomes unavailable to us, we may suspend or cancel the affected booking where reasonably necessary.
9. Security deposits
A refundable security deposit may be required for a hire. Where applicable, the amount will be shown or communicated as part of the booking.
A security deposit is separate from the hire charge and may be retained in whole or in part where LJM Plant Hire has a valid contractual entitlement to recover amounts arising from the hire.
This may include, where applicable, loss, damage, missing items, cleaning, unauthorised extensions or other sums properly due under the hire agreement.
Any remaining refundable balance will be returned after the hire has been completed and the equipment has been assessed. The time taken for a refund to appear in your account may depend on the payment provider and your bank.
10. Delivery and collection
Where delivery or collection forms part of the booking, you must provide accurate site and access information.
You are responsible for ensuring that the location can be accessed safely and lawfully by the relevant delivery or collection vehicle and that an appropriate person is available where required.
Delivery and collection times may be estimates rather than guaranteed appointment times unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, including traffic, weather, site-access problems or operational disruption.
11. Your responsibilities during the hire
From the point at which equipment is supplied until it is returned to or collected by LJM Plant Hire, you are responsible for taking reasonable care of it.
You must:
- use the equipment only for a lawful and appropriate purpose;
- ensure it is operated only by suitably competent and, where required, appropriately qualified persons;
- follow applicable operating and safety instructions;
- carry out appropriate checks before and during use;
- keep the equipment reasonably secure when unattended;
- not deliberately misuse, abuse or overload the equipment;
- not sell, dispose of, pledge or otherwise part with ownership of the equipment;
- not make unauthorised alterations or repairs;
- tell us promptly about breakdowns, accidents, theft, loss or significant damage; and
- make the equipment available for collection at the end of the agreed hire.
12. Suitability and safe use
You are responsible for deciding whether the equipment selected is suitable for the work, location and conditions in which you intend to use it.
Any information we provide about equipment does not remove your responsibility to operate it safely and in accordance with applicable law, manufacturer guidance and appropriate site safety procedures.
You must stop using equipment where continued operation would be unsafe or could cause further damage and contact us as soon as reasonably practicable.
13. Breakdown or faults
If equipment develops a fault or breaks down during the hire, contact LJM Plant Hire promptly and provide reasonable information about the problem.
You must not arrange substantial repairs or alterations without our agreement unless immediate action is reasonably necessary to prevent injury or further serious damage.
Where a breakdown is not caused by misuse, damage or another matter for which the customer is responsible, we will take reasonable steps to address the issue. The appropriate remedy will depend on the circumstances and may include repair, replacement equipment, adjustment of hire charges or another reasonable solution.
14. Loss, theft and damage
You must tell us promptly if hired equipment is lost, stolen, damaged or involved in an accident.
You may be responsible for reasonable losses or costs resulting from loss or damage where responsibility falls on you under the hire agreement or applicable law.
We will take account of the circumstances, the condition of the equipment and fair wear and tear when assessing any amount properly due.
15. Hire extensions
If you need the equipment for longer than originally booked, you should request an extension before the existing hire period expires.
An extension is subject to availability and is not confirmed until accepted by LJM Plant Hire.
Additional hire charges may apply. Continuing to retain equipment after the agreed hire period without an approved extension may result in additional charges and may affect other bookings.
16. Cancellations
If you need to cancel a booking, contact LJM Plant Hire as soon as reasonably possible.
Whether any amount is refundable will depend on the stage of the booking, costs already reasonably incurred, whether plant has been allocated or dispatched, and any cancellation terms communicated when the booking was made.
Where you are legally entitled to a refund or cancellation right, nothing in these terms removes that entitlement.
17. Our right to refuse, suspend or end a hire
We may refuse, suspend or end a hire where reasonably necessary, including where:
- required payment or identification has not been provided;
- information supplied appears materially false or misleading;
- we reasonably believe the equipment is being used unlawfully or unsafely;
- the equipment is at material risk of loss, theft or serious damage;
- the customer materially breaches the hire agreement; or
- circumstances outside our reasonable control mean we cannot safely or lawfully continue the hire.
Where reasonably practicable, we will explain the reason and allow an appropriate opportunity to resolve a remediable issue.
18. Insurance
You are responsible for ensuring that you have any insurance which you are required by law or by the terms of your hire to hold in connection with your use, possession or operation of the equipment.
Unless expressly confirmed by us, you should not assume that your liabilities in relation to hired equipment are covered by insurance arranged by LJM Plant Hire.
19. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to those rights and restrictions, neither party will be responsible for losses that could not reasonably have been foreseen when the relevant agreement was made.
Where you are acting in the course of a business, LJM Plant Hire will not be responsible for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or business interruption except where applicable law provides otherwise.
20. Events outside our control
We will not be responsible for failure or delay caused by events outside our reasonable control.
This may include severe weather, transport disruption, accidents, equipment failure despite reasonable maintenance, utility or communications failure, government action or other unforeseeable operational disruption.
We will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.
21. Personal information
We process personal information in accordance with our Privacy Policy.
This includes information supplied during the booking process, identity verification information and information associated with payments and customer accounts.
22. Intellectual property
The content, branding, design and other material on this website may be protected by intellectual property rights.
You may use the website for its intended purpose but may not reproduce or commercially exploit protected website material without appropriate permission.
23. Changes to these terms
We may update these Terms & Conditions from time to time. The terms applying to a particular hire will ordinarily be those in effect when the relevant agreement is entered into, unless a change is required by law or subsequently agreed.
The current website version will display its latest revision date.
24. Governing law
These terms and any dispute or claim arising from them are governed by the laws of England and Wales.
If you are a consumer, you may also have rights relating to the courts applicable to the part of the United Kingdom in which you live.
